Terms of Service

bycaptur.io is a business platform intended for adults only. By using our Services, you confirm you are at least 18 years of age.

You must have the legal capacity to enter into a binding contract in your jurisdiction.

You must not be located in, or be a national or resident of, any country subject to applicable sanctions or export restrictions that would prohibit use of our Services.

You must provide accurate, current, and complete information when creating your account and keep it updated.

You are solely responsible for keeping your password secure. We strongly recommend enabling multi-factor authentication. bycaptur.io will never ask for your password via email or support channels.

Each account is for a single user or organisation. You may not share login credentials with others outside your authorised team members on a paid plan that permits multiple seats.

You must keep your account information accurate and up to date. Providing false information may result in account suspension or termination.

Generating, distributing, or promoting content that is illegal, defamatory, discriminatory, harassing, or otherwise harmful to any person or group.

Using bycaptur.io to send unsolicited communications, create misleading advertisements, or engage in deceptive marketing practices in breach of applicable consumer law.

Attempting to reverse engineer, scrape, or exploit the platform; circumventing rate limits or access controls; or introducing malicious code or vulnerabilities.

Reselling, sublicensing, or white-labelling the Services without our express written consent.

Impersonating any person, business, or entity, or misrepresenting your affiliation with any person or organisation.

All software, technology, design, trademarks, and content comprising the bycaptur.io platform are owned by or licensed to Lion Tech Group Pty Ltd. You receive a limited, non-exclusive, non-transferable licence to use the Services during your subscription.

You retain ownership of all content, data, and materials you upload to or create using bycaptur.io ("Your Content"). You grant bycaptur.io a limited licence to host, process, and display Your Content solely to provide the Services to you.

Subject to applicable law, outputs generated by bycaptur.io's AI tools based on your inputs are assigned to you upon creation. You are responsible for ensuring such outputs do not infringe third-party rights.

If you provide feedback or suggestions about the Services, you grant us an unrestricted, royalty-free licence to use that feedback to improve bycaptur.io without any obligation to you.

Subscriptions are billed monthly or annually in advance depending on the plan selected. All prices are in Australian Dollars (AUD) unless otherwise specified and are inclusive of GST.

We may change subscription prices with at least 30 days' written notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

If payment fails, we may suspend access to paid features until payment is resolved. We will notify you of failed payments and provide a reasonable period to update your payment details.

You are responsible for any applicable taxes beyond Australian GST. International customers may be subject to additional local taxes which are your responsibility to remit.

You may cancel your subscription at any time through your account settings or by contacting support@captur.com.au. Cancellation takes effect at the end of your current billing period. Please refer to our Refund & Cancellation Policy for details.

We may suspend or terminate your account for breach of these Terms, non-payment, or conduct we reasonably determine is harmful to other users or the platform, with or without notice depending on severity.

Upon termination, your right to access the Services ceases. Your data will be retained for 90 days following termination, during which you may request an export, after which it will be deleted in accordance with our Privacy Policy.

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes that cannot be resolved informally.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other applicable consumer protection legislation.

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and bycaptur.io regarding the Services.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to an affiliate or successor entity.
